1. Parties to this Agreement

This user agreement (referred to hereinafter as the Agreement) contains the terms and conditions of the use of the www.aesir-copenhagen.com Online Store (referred to hereinafter as the Service) owned by ÆSIR COPENHAGEN (referred to hereinafter as ÆSIR COPENHAGEN and/or Æsir). When a person (referred to hereinafter as the User) orders a product / products, he or she agrees to this Agreement.

2. Use of the Service

2.1. The Service is intended for customers in the following countries: Australia, Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Russia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Ukraine, United Kingdom.
2.2. You must be eighteen or older to order products from the Service.
2.3. Everything in the Service, including, but not limited to, images, drawings, sounds, films, graphics and text, is protected by worldwide copyright and other proprietary laws and treaty provisions. ÆSIR COPENHAGEN grants you a limited license to access and make personal use of this site. It is forbidden to download, (except where specifically invited through the use of the word “Download”), to duplicate, to sell or to modify, any portion of this site without express written authorization from ÆSIR COPENHAGEN.

3. User Responsibilities

3.1. The User accepts responsibility for all activities that occur under his/her account or password. The User is solely responsible for maintaining the security of his/her password.
3.2. The User warrants to ÆSIR COPENHAGEN that the information he/she provides during the ordering process (and any notification of change of such information) is true and correct.
3.3. The User warrants that he/she is over 18 years old.

4. Ordering and Payment Terms

4.1. A binding sales agreement between the User and ÆSIR COPENHAGEN is reached when the User places the order in the Online Store. The User hereafter receives an “Order” confirmation email.

5. Product Prices

5.1. The product price is the price displayed for the item on the Service at the time of ordering.
5.2. Delivery charges are included in the product price.
5.3. All the product prices are displayed in euros (EUR).
5.4. All the product prices include applicable VAT, local duties and taxes.
5.6. VAT is not charged on products delivered to companies located inside the EU provided that the company holds a valid VAT registration number from the company’s home country.

6. Delivery

6.1. Delivery times vary from product to product. Delivery time is determined by availability of the product and order destination.
6.2. ÆSIR COPENHAGEN shall not be liable for delays in performing or failure to perform according to this Agreement or failure to fulfil any obligations hereunder, which are directly attributable to causes beyond ÆSIR COPENHAGEN’s reasonable control (force majeure), including, but not limited to, acts of God, fires, strikes, labour disputes, war, acts or interventions by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.
6.3. ÆSIR COPENHAGEN reserves the right to deliver different products ordered in the same time separately.

7. Cancellation and Returns

7.1. The User has a fourteen-day right to return or exchange a product according to Danish consumer protection legislation. This returns policy does not extend to products which are produced or altered according to the customer’s wishes. These products are clearly indicated as ”Made-to-Order” in the product details.

The customer has a right to return a product if
7.1.1. The order has been cancelled according to the terms and conditions by notifying Æsir Customer Service shop@aesir-copenhagen.com within 14 days of delivery,
7.1.2. The product has not been used,
7.1.3. The product is in the condition that the customer received it in and all the parts of the product are included in the package and
7.1.4. The product has been repackaged into its original package.

7.2. The product must be returned immediately after cancellation.
7.3. When returning products the User will be responsible for the risk of damages. We therefore suggest insuring all items before returning them.
7.4. The price of the returned product and the original shipping cost to deliver it to the User will be refunded. Costs related to the return of the product, including shipping and taxes are the responsibility of the User.
7.5. A damaged item will not be accepted as a return or exchanged if it cannot be established that the item has been damaged during the first shipping.

Refunds
The price of the returned items will be refunded on your credit card used for payment. The reimbursement will take place as soon as we have received and inspected the returned item. This will result in a delay of some time – expectedly within 2-3 weeks - before the refund is visible in bank records.

8. Changes to the Service and this Agreement

ÆSIR COPENHAGEN reserves the right to make changes to the Service, to policies, and this User Agreement at any time.

9. Jurisdiction and Settlement of Disputes

This User Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of Denmark. Any contractual disputes are primarily settled through negotiations. Secondarily disputes are settled at the District Court of Copenhagen.

4 HOW TO ORDER

Who can order?

ÆSIR COPENHAGEN’s Online Store is available to private customers from: Australia, Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Russia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Ukraine, United Kingdom. You must be eighteen or older to qualify as a customer.

Confirming Orders

When placing an “Order” you will be asked for your credit card information. After you have placed an “Order” you will receive an automated response that your order has been received and is being processed. Within a few working days from this, you will receive a formal confirmation of order, along with an estimated shipping date. Finally, you will be informed via email when your order ships.

5 PAYMENT

Methods of Payment

You can purchase items using MasterCard, Maestro, Visa, Visa Electron and JCB credit cards. You can purchase items using an American Express credit card by telephone order. For improved security, our Online Store also uses the Verified by Visa-system, which enables upgraded security for money transactions.

6 DELIVERY

Methods of Delivery

ÆSIR COPENHAGEN’s Online Store ships deliveries.

Delivery Insurance

All delivered items are insured. If you find the parcel damaged before opening, notify the delivery company immediately upon delivery. If you have opened the parcel before finding the item damaged, notify ÆSIR COPENHAGEN Customer Service immediately. When you are returning items, you will be responsible for the risk of damages. We therefore suggest insuring all returned products.

Liability for Faulty or Damaged Items

Faulty goods or items damaged during shipping have to be reported to Æsir Customer Service within two working days of receiving the product. ÆSIR COPENHAGEN will strive to replace the faulty or damaged item, but if this is not possible, the customer will be reimbursed with the full amount of costs. The fault or the sustained damage must be documented by due process and with appropriate photographs. ÆSIR COPENHAGEN will not deliver a replacement before the fault or damage has been confirmed.
Please follow the instructions provided by Æsir Customer Service with all matters regarding the reclamations process.

The original version of these Terms and Conditions and all agreements between ÆSIR COPENHAGEN and their customers are concluded in the English language. In case of any inaccuracy or discrepancy between the original English version and any translation of these Terms and Conditions the present Terms and Conditions in the English language shall prevail.
